The Site is operated by GoodHeart Real Estate LLC, doing business as Good Heart Real Estate ("Good Heart Real Estate," "we," "us," or "our").
By using the Site, submitting a form, requesting a consultation, or communicating with us, you agree to these Terms. If you do not agree, please do not use the Site.

We provide residential real estate services, including helping clients buy, sell, and relocate to homes, condos, and land across East Hawaii.
You must be at least 18 years old to use this Site, request a consultation, or consent to receive communications from us. By using the Site you represent that you are 18 or older and that the information you provide is accurate and complete.
This Site is an informational and lead-generation website. It describes our services and allows you to request a consultation or contact us. We do not sell goods or process purchases through this Site. Nothing on this Site is an offer to buy or sell property, an appraisal, or legal, tax, or financial advice.
Content on the Site, including property information, market information, and service descriptions, is provided for general information only, is believed to be reliable but is not guaranteed, and is subject to change without notice.
Submitting a request through the Site does not create an agency relationship, a brokerage agreement, or any contract. Any representation of a buyer or seller begins only under a written agreement signed by you and the brokerage. Where a signed listing, buyer representation, or purchase agreement conflicts with these Terms, the signed agreement controls for that transaction. Commissions, fees, and obligations are governed by those signed agreements, not by this Site.
This section describes our text messaging programs and applies to any mobile number you provide to us.
GoodHeart Real Estate LLC (DBA Good Heart Real Estate) operates two separate text messaging programs:
Customer Care / Transaction Updates (non-marketing): messages about your real estate inquiry, consultation and showing appointment confirmations and reminders, transaction updates, and replies to questions you send us.
Promotional / Marketing (optional): new listings, market updates, open house announcements, real estate-related promotional messages, and requests to leave a review.
Consent to each program is collected separately. Consent to receive marketing messages is not a condition of purchasing any property or service, and declining marketing messages will not affect the services you receive from us.
SMS consent is collected through two separate, optional SMS consent checkboxes on our website sign-up form at https://goodheartrealestate.com/sign-up. One checkbox is for Customer Care / Transaction Updates and the other is for Promotional / Marketing messages. The checkboxes are not pre-selected, and you may submit the form without providing SMS consent. SMS consent is not collected through phone calls, verbal agreements, written agreements, or by texting us first.
Message frequency varies. Customer care and transaction update messages are sent as needed based on your inquiry and your interactions with us. Promotional messages, if you have opted in to them, are sent periodically.
Message and data rates may apply. Your mobile carrier's standard messaging and data charges apply to messages sent to or received from us. Good Heart Real Estate does not charge for text messages.
You can cancel text messages at any time by replying STOP to any message from us. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT. After you send one of these keywords, we will send you a single confirmation message and will not send you further text messages unless you opt in again. No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Information may be shared only with service providers that support the operation of our messaging program (for example, our messaging platform provider), and only for that purpose, or where disclosure is required by law. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Text messaging may not be available on all carriers or devices. Please do not send confidential information, bank account numbers, or other sensitive personal information by text message.
By providing your phone number or email address, you agree that we may contact you by phone, voicemail, and email regarding your inquiry, consultation, and transaction. You may ask us to stop contacting you at any time.
You agree not to use the Site to submit false or misleading information, to submit another person's contact information without their permission, to interfere with or disrupt the Site, or to use the Site for any unlawful purpose or in violation of these Terms.
The Site and its content, including text, photographs, graphics, and design, are the property of GoodHeart Real Estate LLC or its licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, or use our name or content without our prior written permission.
If you provide a review, testimonial, or feedback about our services, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it on the Site, in our marketing materials, and on social media, along with your first name and general location, unless you tell us otherwise in writing.
The Site may link to third-party websites or services that we do not own or control. We are not responsible for their content, policies, or practices, and we encourage you to review their terms and privacy policies.
The Site is provided on an "AS IS" and "AS AVAILABLE" basis. You agree to indemnify and hold harmless GoodHeart Real Estate LLC from any claims, damages, or expenses arising out of your misuse of the Site, your violation of these Terms, or your submission of another person's information without authorization.
These Terms are governed by the laws of the State of Hawaii, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Hawaii.
If you have a concern or dispute, you agree to first contact us and attempt to resolve it informally. If we cannot resolve the matter informally within thirty (30) days, either party may pursue other remedies available under law.
If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
We may modify these Terms at any time. Changes take effect when posted to this page, and the "Last updated" date above will be revised. Your continued use of the Site after changes are posted means you accept the revised Terms.
